David Schneiderman Congratulations! I had already adopted another textbook/case book for this Spring semester course. But going forward I may well use this book, along with my own edits of cases.

Pleased to announce that my new book "Constitutional Review and International Investment Law: Deference or Defiance?" is available on Oxford Scholarship online and available to order. Hope it is of interest to both comparative constitutional law and investment law folks.

Honoured to have been invited to contribute a chapter on a canon for constitutional property rights, taking up Pennsylvania Coal v. Mahon, James v. UK, and Port Elizabeth v. Various Occupiers.  What an impressive volume (my contribution aside). Congrats to the editors!

In the UofT’s application for an injunction to remove the encampment, there were many references to the Batty case where the Occupy Toronto encampment was ordered removed. A very poor precedent for reasons explained in my op-Ed from 2011: thestar.com/opinion/free-s…

From the last paragraph:The occupiers were not exemplary neighbours. Instead, occupiers appeared disorderly and upset local residents.Constitutional rights, for Justice Brown, must be exercised in a peaceable way — protesters must give way to dog walkers. That is the Canadian way.

A comment on the University of Toronto encampment ruling authorizing the removal of students from the centre of campus. I argue that the Justice missed the mark by failing to consider whether the common law of trespass was consistent with Charter values.
