I’m very grateful for the generous blurbs for my forthcoming book. I do feel like it’s one of the best things I’ve written, and it reflects decades of my thinking about the foreign affairs powers of the government. It’s never too early to pre-order!

Looking forward to this conference here on Friday. A very timely topic, given federal-state conflicts at the southern border and the rise of state (and city) international agreements to address issues like trade, technology development, and climate change.

Here’s a video of a University of Pennsylvania Carey Law School panel on Nondelegation and Foreign Affairs, at which Jack Goldsmith and I presented our new paper on that topic. The panel also features Marty Lederman, Nicholas Parrillo, and Cary Coglianese.

My essay on state international agreements is now open access! Agreements by states (and cities) with foreign governments are a significant and growing part of foreign affairs federalism. Here’s the link:

In this paper, Curtis Bradley and Jack Goldsmith contemplate a reinvigoration of the nondelegation doctrine and whether a foreign affairs exception should be included, especially in light of the President’s relevant independent powers. Read it here: shorturl.at/pA046

The GOP has chosen. They will nominate a man who attempted to overturn an election and seize power. We have eight months to save our republic & ensure Donald Trump is never anywhere near the Oval Office again. Join me in the fight for our nation’s freedom. greattask.com

Excited to be starting a new book project, exploring the intersections between the U.S. constitutional law of foreign affairs and international law conceptions of sovereignty. Thanks to Anu Bradford for inviting me to speak about it today at Columbia Law. law.columbia.edu/events/compara…

I'm looking forward to the annual Chicago-Virginia foreign relations law roundtable. This year, we’ll address the always-relevant topic of foreign relations federalism, made even more pressing by recent federal-state disputes over immigration.

Engaging in the disqualification debate by asking what institutional boundaries must exist before individual states or state officers can disqualify national candidates. Answer might lie in the structure of the 14th Amendment and some comparisons abroad.

As I get ready to teach Federal Courts again, I realize that I’ve been teaching this course for about 30 years. It never gets old, thankfully, in part because there are always new issues to consider. This year, issues relating to former President Trump will get some attention.

In this symposium essay, I explain how cases relating to international law played an important role in the development of the political question doctrine, and how this history is relevant today to a number of other legal doctrines. Happy holidays! gwlr.org/the-political-…

Will be interesting to see whether Biden issues a signing statement about this. Trump’s Office of Legal Counsel argued that provisions like this one are unconstitutional, but its reasoning was weak, and Biden might want to support this sort of guardrail.

If the nondelegation doctrine is revived, should foreign affairs delegations be exempted? Should the “major questions doctrine” apply to such delegations?Jack Goldsmith and I discuss these and related questions in this new paper, forthcoming University of Pennsylvania Law Review. papers.ssrn.com/sol3/papers.cf…

A new draft piece with Curtis Bradley -- 'Foreign Affairs, Nondelegation, and the Major Questions Doctrine.' Fun topic, with many interesting, hard, unresolved issues. Comments welcome. papers.ssrn.com/sol3/papers.cf…

We had a wide-ranging discussion today at the University of Chicago’s center in Paris, focused on the domestic and international law issues implicated by nonbinding international agreements, especially issues of transparency and accountability. ⁦UChicagoParis
