A federal judge ordered Border Patrol to stop sending children to open air detention sites. By sending kids there in southern California, agents violated a consent decree called the Flores Settlement Agreement that sets baseline for how immigration agents treat kids.

After listening to today’s oral arguments over SB4, I left with little that the parties haven’t already said in briefs or past arguments in this case (of which there have been several). Most remarkable was the effort by the attorney representing Texas to narrow SB4’s reach.

The Texas immigration law, Senate Bill 4, must remain on hold, a three-judge panel of the U.S. Court of Appeals for the Fifth Circuit concluded yesterday. The law most likely unconstitutionally impedes on the power that the Constitution assigns to the federal government.

And hours later the 5th Circuit dissolves its earlier 'administrative stay' meaning the district court's preliminary injunction from February 29 is back in force. As such, SB4 is on hold--again & for now. The 5th Circuit hears oral argument at 10:00 CT ca5.uscourts.gov/opinions/pub/2…

Strong statement against SB4 by México's Ministry of Foreign Affairs: 'México rejects any measure permitting state or local officials from exercising control over migration, detention, or deportation of Mexicans or foreigners to Mexican territory.'

Note that in addition to saying México won't accept people deported by Texas, México also isn't promising to dialogue over immigration policy with Texas....

Mexican diplomat for North America: 'Mexico expresses its disapproval of the SCOTUS decision allowing SB 4 to go into effect. Our country will not accept repatriations carried out by Texas. Dialogue on migration will continue between the Mexican and US federal governments. '

Texas can now put SB 4 into practice after a divided Supreme Court breathed life into it this afternoon. As such, Texas law enforcement officers can begin enforcing the state’s own immigration laws through the power of arrest, prosecution, conviction, and deportation.

And SB4 remains on hold thanks to a new order from Justice Alito. Unlike prior orders, this one doesn’t have a specific end date.
