278's do NOT allow records simply be handed over as a whole. A judge reviews them 1st to see if they are relevant. Eg. If the complainant gave a different narrative of the assault to the therapist than they did to the police. That is considered relevant.

I feel compelled to point out that a CSO (which was the sentence here) IS a sentence of jail - served in the community. The SCC has acknowledged that it can be a punitive sentence and usually includes a significant loss of liberty.

One to watch - what's the point of immunity against prosecution for possession of drugs for those who call for help when someone's overdosing if the police can detain and arrest you for possession and then search you and charge you with other things anyway?
