The EuropeanPatentOffice Observatory on Patents and Technology today published a new report on #standards and the European #patent system. The report found presented new data relevant to the discussion of standard #essentialpatents. #innovation #technology

Among other findings 1) the integration of databases from #standards development organisations (SDOs) into the #patent grant process has led to a steady rise in examiner citations of these documents. #innovation #technology

In tech areas with intense #standardisation activity, more than 30% of search reports involve SDO-related files and in some cases, such as video compression tech, go as high as 70%. #innovation #technology

The study also found considerable overlap between the presence and number of citations of SDO documents and the likelihood of a patent being declared a standard-#essentialpatent. The EuropeanPatentOffice suggested this could serve as a useful indicator of #essentiality.

The report also looked at the performance of the Unified Patent Court (UPC) since its inception in June 2023. The UPC has already seen 23 standard-#essentialpatent-related disputes as cases before national courts shrank. #innovation #technology
