Breaking news: The 5th U.S. Circuit Court of Appeals blocked the Texas Education Agency on Wednesday from enforcing a state law requiring booksellers to rate the explicitness and relevance of sexual references in materials they sell to schools. ow.ly/tbV750QrUI2

The Tx district judge and Fifth Circuit did NOT enjoin the mandatory library standards. However, since part of the mandatory standards allude to the vendor ratings, that may cause some confusion. We encourage districts to wait for other legal entities to weigh in.

We also strongly encourage every librarian to remember that you are NOT required to remove mature library materials. In fact, definition of harmful materials in standards says an ENTIRE work must lack literary value AND its DOMINANT theme must be prurient for it to be removed.

We also want to remind every librarian/admin of this part of the new Texas Library standards: "(G) Prohibit the removal of material based solely on the ideas contained in the material." If you are self-censoring due to the ideas within, state standards say that you should not.
