Under the Subsidy Control Bill there can be a six month gap between an unlawful subsidy being announced and it being capable of being challenged. That’s not good law⁩ - ⁦competitors could be driven out of business before the challenge period starts. thetimes.co.uk/article/post-b…

It’s worth keeping an eye on the EU’s Foreign Subsidy Regulation - this will create new, wide powers for DG Competition to tackle perceived loopholes in how subsidies from outside the EU impact the Single Market.

The House of Lords debates the Subsidy Control Bill on 19th January 2022, but without a complete picture of how it will work. The Government should set out what kinds of subsidies will need to be referred to the Competition & Markets Authority or otherwise prohibited, before the Bill is debated.
