As the new Framework was published during the determination period, EP proactively wrote to the LPA setting out the adjusted approach to assessment, under paragraph 154(g) and the substantial harm test for previously developed sites. This was a good opportunity to test the LPA’s

application of paragraph 154)g)! Although the Council did not consider that the proposal met this test, it was considered that VSCs, as detailed in the submission, exist. It will be interesting to closely monitor how the Council apply paragraph 154(g) going forward.
