I just noticed that Pamela Bookman's "Arbitral Courts" has been published. vjil.org/current-issue: "states...have been establishing something in between courts and arbitration....this Article identifies, theorizes, and explores the significance of these new arbitral courts."

Few things in life make you question the supposed glories of federalism more than sitting in the DMV for an hour, waiting to re-title an out-of-state car.

Agreed that this is super weird. But the best values, by my lights, are John Paul Stevens and Harlan Fiske Stone at $4 apiece. (Notwithstanding his plodding writing style, Stone was arguably the greatest proceduralist on the Court in the first half of the twentieth century.)

I'm still processing the Washington and Lee University Trustees' decision, but I have some thoughts about their statement regarding it, which strike me as deeply problematic in numerous ways (thread).

Congress may not violate the Constitution and then try to cover it up through jurisdiction stripping. This is exactly what Schumerā€™s No Kings Act tries to do, write Dan Epps and Alan Trammell on.wsj.com/3WOWNWq

Senator Schumerā€™s new op-ed defending the No Kings Act. He relies on Ex Parte McCardle as precedent. But as Alan Trammell and I explained in the The Wall Street Journal yesterday, that case and others show why this wonā€™t work. Link replies. washingtonpost.com/opinions/2024/ā€¦
