Big news courtesy of Mirko Brüß, LAION has successfully defended a copyright infringement challenge in a German court. This is the first European case testing the TDM exceptions in the DSM Directive. linkedin.com/posts/mirko-br…

Most importantly, this is the biggest evidence so far that the DSM does indeed cover AI training, something that most of us have argued from the start. It will be interesting to see if this is appealed, and if so, if it eventually makes it to the CJEU.
