Companies won’t be notified, and therefore could fail to file, the equivalent UK right for a pending EU TM or EU design application on 31 Dec 2020.

Companies may not realise that EU TM and design rights will be split in two, and may neglect to pay the two renewal fees required (EU and UK).

Companies that fail to appoint a UK Address for Service for all UK rights, may find that revocation or invalidity proceedings brought against them could succeed (without their involvement) and they could lose their rights.

With the UK now out of the EU, if you had a pending EU #TradeMark or #Design on 31 December 2020, you have until 30 September 2021 to file an equivalent UK application.

If you had a pending International #TradeMark or #Design which included the EU27 countries on 31 December 2020, you have until 30 September 2021 to file a separate UK application to ensure rights in the UK.

The UK may have left the EU but this has no impact on UK and European #patents or using a UK based European Patent Attorney. Nothing has changed, so, it’s business as usual for all your patents.

Now the UK has left the EU, if you need European rights for your #TradeMarks and #Designs, you’ll need to file two separate applications – one for the UK and one for the EU.

From 1 January 2021, if you have international #TradeMarks and #Designs to file you’ll need to list the UK separately to gain UK protection.
