This was received by lawyers days before the Seema Misra trial. It was not disclosed to the defence.

She was jailed for 15 months.

Completely missing the point here.

Adding 20% to independent school fees, within the context of d , will only cause an increase in the costs to local authorities, who are already unable to afford to comply with duties.

I wonder how many of my legal colleagues, in other practice areas, have to prepare their advice (and strategy) along the lines of - 'this is what the law says should happen' - and 'this, then, is what WILL happen'...

LA asks parents if they have specific wording they want in Section A of an - good start
The form then specifies 'no more than 500 words'. How quickly it all falls apart ...

One major part of legal training (that I had) was to write all letter assuming a Judge would one day see it.
This should be exhibited to that training module.

I've been an lawyer for about 16 years (qualified for 12 of that).
Year on year, the understanding of d law by local authority case officers (and I know it has changed in that time) has deteriorated dramatically.
I dread to imagine the training.

A general warning
Beware any definitive legal advice offered via social media.
Especially when delivered from individual(s) with no legal qualification and/or training
Seen some rather interesting interpretations of law and Equality Act recently.

The way things are going -- my prediction for appeals is that before December 2024 we will be seeing appeal timetables of up to 18 months.
This is NOT a criticism. It is a mere observation of the reality with trying to sort out disputes now

Child Law too- the Law Society operates the Children Law Panel to ensure competence of lawyers representing vulnerable young people.
Difficult to see cases being less vulnerable or needing of similar protection.

It's non-statutory guidance.

About as empowering as a stick of 8-week old celery.

(I avoided a lettuce comparison)

It begins
The letters from local authorities saying 'we know today is the deadline, so here is an EHCP naming type only. We've done this because we don't want to name your preferred school, but we cant find anything else'
Every year.

A different experience today
Witness for the LA's proposed school visibly exhausted from having to try to make room for children that the LA are placing at their school, despite being massively over capacity.
The strains are showing everywhere.

Parent called me today

Their local authority (will not name, as could identify the parent) told them to 'sell some organs' when the parent asked how they were expected to run an appeal

In the context of 95%+ success rate

Despicable, inhuman and sickening

Bracknell Forest LA to GP, re: medical advice abt SEND pupil:

“Your letter… …purports to provide the parents with both a shield against enforcement for non-school attendance & a sword for parents to demand expensive open ended home schooling packages” bracknellnews.co.uk/news/24088582.…

Incredible disclosure today

An internal email from Staffordshire County Council saying that Head of has directed the Team must defend all dyslexia appeals

Email continues that 'unfortunately' the LA has to prepare a 'strong case'

so much to unpick
