House v. NCAA settling & college athletes unionizing are on very different timelines. That presents a legal problem if athletes' share of revenue is capped. Should Congress let college athletes collectively bargain without employee status? CFBPA says yes: sportico.com/law/analysis/2….

As the FTC seeks to ban noncompete agreements, an interesting federal lawsuit is playing out in Boston involving a former DraftKings executive who joined Fanatics and his noncompete. The executive is appealing an injunction. Eben Novy-Williams & I have more: sportico.com/law/analysis/2….

In a few days, sources went from feeding journalists info about 'deep discussions' on a sweeping settlement with the NCAA, including revenue sharing, to specific details disseminated and a deadline to accept.

The claims that a settlement in House, etc could resolve the issues in college sports seem to stem from confusion about how settlement agreements work.

Settlement is wise, for Ps’ attys to collect fees & for NCAA et al, but it won’t stop other antitrust suits or fix all issues…

Jeff Pash has friends & foes in sports law, but there's no getting around his instrumental role in shaping major NFL legal controversies and, with him running point on law issues, advancing the league's massive economic success. My take on his retirement: sportico.com/law/analysis/2….

This is a very interesting concept (and excellent reporting) but unless the powers-that-be in college sports negotiate their new world order with a players union & that union agrees to it, their new world will face more antitrust lawsuits. I explain here: sportico.com/law/analysis/2…

With talk of revenue sharing by conferences, colleges, athletes and players associations, there's a critical missing piece: a union. Without it, any 'sharing' would be subject to antitrust litigation.

In a new article, I dive into the key legal issues: sportico.com/law/analysis/2….

NEWS: The retired judge mediating the Minnesota Timberwolves sale dispute this week has a deep history with sports meditation/arbitration, including--and this surprised me--a recent lawsuit against Glen Taylor.

Revenue sharing in a world where college athletes aren't in a union--being in a trade association doesn't count--and where rules for sharing TV money aren't collectively bargained would invite problems for NCAA & conferences. It's very complicated. Like the bar exam on steroids!

The NCAA settling the House & Carter antitrust cases would go a long way in helping it resolve big legal problems. But it wouldn't resolve other antitrust cases or whether college athletes are employees who can unionize. It may even cause new legal woes: sportico.com/law/analysis/2….
