One possible outcome that Michael McCann and I discussed on my podcast is that the judge sends the settlement back to the parties to tweak/rework it. Seems like that's where we're headed. podcasts.apple.com/us/podcast/ep-…

Judge Wilken: "I am not prepared to make a decision to preliminarily approve" the settlement but she thinks they could land a deal after making changes she is asking for—but also says maybe they can't strike a deal and it goes back to litigation. The headline: there's no deal.

Jeffrey Kessler wants Judge Wilken to set a deadline because there's a chance they can't reach a new settlement and the cases go back on the docket. Pretty stunning development. This NCAA settlement that's been talked about like a done deal now has a good chance of collapsing.

As expected, it appears the always overly-confident NCAA misjudged its ability to sell a dubious class action settlement to a federal judge who’s been on the bench for more than 40 years and ruled against the NCAA in the O’Bannon case. 🤦🏻‍♂️

What a night for sports law. The NCAA's epic, but not yet approved, settlement to resolve three big antitrust cases and reshape college sports into something like a pro league faced a skeptical judge. My keys from the hearing and what will happen next: sportico.com/law/analysis/2….

Michael McCann Great analysis and summation 💪🏻 It appears as though employment and pay-for-play are hard stops for the NCAA. Viewing the hearing was quite telling considering how the tone and body language changed as soon as Judge Wilken told the parties to return to negotiations…
