Does the use of a trademark in the code fall under the GPL? The GPL says so, but it's honestly the first time I've thought about it.

Intellectual property inherits the GPL when distributed as part of the program.

My apologies to anyone who is pissed at me about TMs (and just TMs). I guess we have different definitions of "free software."
