In Montana, where voters might determine which party controls the U.S. Senate, hundreds of people in Bozeman are currently waiting in a 5-hour line in freezing temperatures so that they can register to vote and cast their ballots.

Your regular reminder that Election night "calls" are unofficial. The election isn't over until the state election officials certify the results in a week or two (depending on state law).

RESULT: Pamela Goodwine wins Kentucky's supreme court race. Goodwine was the candidate backed by Dems in this nonpartisan race; she defeats the candidate backed by conservatives. (This was not statewide.) Retiring justice was conservative, so this takes the court a step left.

Your friendly reminder that there's no such thing as a "lead" as election officials count the vote. In America, we count all votes. Then we know who won.

Many voters were confused by the ballot summary, which said this commission would create more gerrymandering instead of eliminate it.

This was just an all-around rout. Amendment 2 (allow legislature to fund K-12 ed outside public school system) lost in every single county. Only one (McCreary, 53-47) was within single digits.

Once again 1/3 of the electorate didn't vote. Maybe the outcome would have been the same. Maybe not. Either way, we need to engage nonvoters and completely rewire how we approach civics education in a bipartisan way.

One benefit of teaching Con Law II: I learned about @coleswhalen's music based on the Counterman case. She suffered horrible stalking, which turned into a free speech case on hate speech. Terrible what she suffered but I'm glad to hear her music, which is great!
