No one is using FISA Section 702 to spy on Americans. Americans communicating with foreigners targeted under Section 702 may be incidentally collected - and this is entirely permitted by the 4th Amendment.

For you to say otherwise is inaccurate and constitutionally illiterate.

And, to be clear, the 702 bills promoted by the Freedom Caucus and Mike Lee would require a warrant not just with respect to US citizens but also for 'persons reasonably believed to be located in the US at the time of the query' - e.g., foreign spies and terrorists. Yikes!!

Those looking to gut the legislation seeking to reauthorize Section 702 have become real fire breathers now that the FISC has approved the conduct of the Section 702 program for another year - so that there are no immediate calamitous consequences from their idiocy.

Agree that dropping the prosecution would be a serious mistake - from both legal and national security perspectives. We can quibble about the parameters of an appropriate resolution but there are good reasons not to simply allow this to lapse.

Lee is an absolute carnival barker. None of the bills that have been introduced regarding the reauthorization of Section 702 has called for a 'clean' reauthorization. Lee's bill, the SAFE Act, is one of the worst of those bills.
