I was way ahead of the cuve sugesting that presidential 'debates'--at least in the format we've had them since 1976-- should be abolished. They offer little of value and result in a less informed electorate. I wrote as much in the Connecticut Law Review back in 1996.

SCOTUS called for a response from the government. Not a sure sign, by any means, but a necessary first step if the Court wants to grant very. Keeping my fingers crossed for my friends at Institute for Free Speech. supremecourt.gov/search.aspx?fi…

The introduction of this bill is an important development in Ohio, a state that earned an 'F' grade in Institute for Free Speech's most recent 50-State Anti-SLAPP Report card:

Today Institute for Justice filed an amicus brief in support of certiorari in an important First Amendment case being litigated by Institute for Free Speech. The case raises important questions about the limits on the government's power to require disclosure in political ads. 🧵

I recently received a summons for jury duty on a date on which I will be out of the country. It's kind of cool when you have to ask the judge for an exemption, and the judge is your former student. Apparently, he doesn' hold a grudge--I was excused. 🙂

The most under-reported and under-discussed story of 2023: a federal district court judge, upheld by a unanimous appellate panel, found the Biden WH and FBI committed one of the gravest attacks on the 1st Am in decades by coercing Big Tech to censor dissent online.

$3 billion sounds like a lot, but it’s about 3 hours of spending for the the federal government, well under 5 percent of total campaign spending since Citizens United. It is one of the great non-issues of our time.

A new American Edge Project poll finds that 90% of voters worry that heavy-handed regulatory policies aimed at the U.S. tech sector could make us less safe, expose our critical infrastructure to cyberattacks, and help China conduct espionage attacks. bit.ly/AEP_BG24

I’m kinda trying to figure out Dan Miller’s point here, because it’s pretty clear in the transcript that Biden is totally lost; Hur is doing what one does in a deposition-letting the witness dig a hole-and Biden’s lawyer immediately asks for a break after this exchange.
