I was arrested, arraigned, indicted, & arraigned again. 10mo+ of court dates, then a complete dismissal. I demanded the arrest property back. The ADA refused. NYPD ignored all correspondences and efforts. I sued, they appeared, & then destroyed some items. What am I missing?

I, AGAIN, asked for *my* property back. Corporation Counsel says “…your [property] descriptions are vague…” The aforementioned descriptions included the exact package numbers from the NYPD invoices, the same invoices counsel claimed to have preserved. WTEF

The City destroyed evidence. I asked the court to grant spoliation sanctions. The court denied the motion (due to an alleged “litigation hold”) & instead ordered a “meet-and-confer” on the cost of the destroyed item (only). I objected. The magistrate vacated the entire order.

I was arrested by NYPD & this is the warrant they allegedly relied on, signed by a federal magistrate. Notice how it references attachments? NYPD never produced those attachments & there was no affidavit supporting the warrant. Is the system broken or working as intended?

NYPD has no legitimate process for returning seized property. That includes cash, license plates, papers… the list goes on. Invoicing officers don’t follow invoicing procedures and property clerks don’t follow return procedures. home4.nyc.gov/assets/nypd/do…

In my criminal case, the judge ordered the People to revise the indictment to designate the alleged crime of gun possession as an armed felony offense. I challenged him and won — there was no armed felony offense because the guns weren’t deadly or loaded.

I think it’s safe to say we all made bold decisions that day. For the record, I’ve never filed a lien against any public agent, ever. It may also be safe to say, Cit agents know exactly who I am. They called the Part Clerk to find me — they know who I am and where I was.

I made a motion in the SDNY for return of arrest property in a now closed crim matter. The DOJ returned the prop. in 12 days. I made a similar demand to NYPD NEWS & Brooklyn District Attorney Eric Gonzalez. They forced me to sue. It’s been 11 months. Why does the state have to over complicate EVERYTHING?

.NYPD NEWS Defense Counsel acknowledge that *my* “arrest evidence” property has been withheld, citing CoNY Admin. Code § 10-131(i)(3) as a defense. That code prohibits pistol and revolver ammunition possession. None of the property is pistol or revolver ammunition.
