We are deeply concerned about the unfavourable judgment of Nakuru ELC PET 1/2023 delivered on 30th May 2024,that has failed to take into account the judgment of 2017 and 2022 .We wish to RESTORE HOPE of the community by assuring them that the African Court rulings still STAND

Long awaited ruling from African Commission on Human and Peoples' Rights that breaks new ground on multiple fronts (see thread). This is the first time an HR body finds violations of the rights to health, education and environment in the context of conservation-related displacement of IPs.

The ACHPR also "Declares that fortress conservation models based on the exclusion of indigenous peoples from their ancestral lands without their free and prior consent are ineffective, and...

Lara Dominguez Rush (@ldominguezrush) 's Twitter Profile Photo

recalls that, in cases where such conservations are necessary, their impact on indigenous peoples must be carefully analysed and remedied. In particular, the conservation model used in the Kahuzi-Biega National Park has failed, by excluding the Batwa as custodians of the forest"

Lara Dominguez Rush (@ldominguezrush) 's Twitter Profile Photo

DRC has an obligation to implement the ruling, but so does WCS. If DRC does not return the lands to the Batwa, and the eco guards WCS manages continue to violently exclude them from the park, WCS will be complicit in and responsible for the ONGOING violation of 11 Charter rights.

Credit where credit is due: Many thanks to Colin Luoma & Jennifer Castello who helped me draft the merits brief & the invaluable support of Julie Barriere, ERND (particularly Innocent Bisimwa) & Rainforest Foundation Norway (RFN) throughout the process.

And a special recognition to Lucy Claridge who filed the case before the ACHPR, obtained a favourable admissibility decision and fundraised tirelessly as MRG Legal Director to ensure this case could be pursued.
