FamilyLawHour I like this idea and think an FDR type hearing for these kinds of disputes could be beneficial. I suspect we would see cases settling much earlier and at much less cost to the parties
Lisa Burton-Durham FamilyLawHour I like the idea of an FDR type hearing for unmarried couples and I understand that this type of hearing is being utilised more, but I would be interested to know how common it is in practice.
FamilyLawHour It seems that getting a mortgage is a common reason - I just wonder how many times when that is the reason are the couple told about the option of having a declaration of trust? Never in my experience.
Patricia Beckett FamilyLawHour Do you think schedule 1 of the CA does enough to protect those who are carer of children whose name is not on the house and mortgage? Should it be that Schedule 1 is reformed as a priority rather than cohab laws?
Raj Patel Jim Fitch FamilyLawHour I think this is one of the biggest issues we have. My experience is that buyers are given a 'factsheet' about joint tenants and tenants in common and told to tick the one they want. Should there be more responsibility on the conveyancers to explain (not advise) the risks?
FamilyLawHour Yes and it is often a very difficult conversation with a client explaining that where they are unmarried the court is not concerned with meeting needs.
Sarah FamilyLawHour Christopher Maulkin It really does - especially where they bought as tenants in common with a declaration of trust and no one advised them at the time on standing of that document if they were to later marry.
