FamilyLawHour I like this idea and think an FDR type hearing for these kinds of disputes could be beneficial. I suspect we would see cases settling much earlier and at much less cost to the parties

FamilyLawHour It seems that getting a mortgage is a common reason - I just wonder how many times when that is the reason are the couple told about the option of having a declaration of trust? Never in my experience.

My experience is that buyers are given a 'factsheet' about joint tenants and tenants in common and told to tick the one they want. Should there be more responsibility on the conveyancers to explain (not advise) the risks?

FamilyLawHour Yes and it is often a very difficult conversation with a client explaining that where they are unmarried the court is not concerned with meeting needs.
