'We still have health care deserts across the country, being able to just go directly to the pharmacy and purchase [birth control] is a really amazing opportunity and very important.'

Its concerning because reviving Comstock is a key facet of the anti-abortion movement’s strategy for banning abortion nationwide. A future prez administration could interpret & enforce Comstock to ban not only abortion pills, but any instruments related to abortion care. /15

4) Justices expressed concern that courts were second-guessing FDA’s scientific experience. Jessica Ellsworth, representing Danco, noted that plaintiffs’ arguments “would upend not just Mifeprex but virtually every drug approval & REMS modification FDA has made for decades” 13/

3) Telehealth medication abortion is safe, despite plaintiffs’ attempts to claim otherwise. Ps argued that in-person visits with ultrasounds are necessary – but studies and leading medical orgs say that mifepristone can be safely taken w/o an ultrasound or in-person visit. 12/

What plaintiffs are really arguing here – as Justice Jackson pointed out best – is that their ability to conscientiously decline to provide care is not enough, and instead no one should have access to mifepristone because a handful of doctors object to abortion care. 8/

Though I'm hopeful after today's argument that the Supreme Court will dismiss the mife case, it's important to remember how bonkers it is that this wildly meritless case reached the Supreme Court. The fact that plaintiffs made it this far is a serious problem.
