This could be a big one. SCC's first foray into the BC legislation (and first decision on #antiSLAPP laws since Pointes & Bent in 2020). Lots of interesting issues the Court may pick up on, including nuances on how to properly conduct the public interest weighing analysis.

"A dark day for freedom of the press" indeed. Carole Cadwalladr ordered to pay more than £1m in court costs to businessman Arron Banks, despite a judgement ruling that her reporting was in the public interest at the time of publication. Such cost orders deter vital reporting.

DMG recently assisted a media client in a successful anti-SLAPP motion. In Armstrong v. Farahi, although the court found that the plaintiff had met the “merits based hurdle”, the court dismissed the case because the plaintiff was found not to have met the public interest hurdle.

The Supreme Court of Canada issued an important judgment today in Canadian Broadcasting Corp. v. Named Person, 2024 SCC 21.  decisions.scc-csc.ca/scc-csc/scc-cs… We welcome this judgment, which confirms that the idea of holding a secret trial in Canada is intolerable.
