I’m reading through interviews with workers who recently unionized and again and again the boss is the best organizer

I think about the f-question in two ways, there's a genetic and structural component. The first is, 'where did this come from?' and the scholarship on the extreme and far right and the continuity it shows with Trump is instructive there, you can trace a lineage from America First

I don't teach torts, but I thought this was a great article from Alexandra Lahav (a reaction possibly aided by my sense that Cardozo is greatly overrated). h/t Gerard N. Magliocca. repository.law.umich.edu/cgi/viewconten…

“Now imagine I turned all of my books backwards. Would the books truly be backwards? Or would they be forward if you are a wall?”

So all Indiana law professors need to engage critical race theory, critiques of political economy, critical feminist discourse, anti-racist discourse, etc. . . . right?

US law reviews have created a truly idiosyncratic culture that allows claims like 'in this article I will argue that I am the first person to ever think about law' while at the same time you have to provide half a page of evidence for something like 'people need food and water'

I just realized that SCOTUS's two major cases on striker replacement are Fleetwood Trailer and Mackay Radio.

So can we now call this the 'Fleetwood Mac' doctine?

My starting point is that I know a ton of people 'addicted' to email and there isn't any algorithmic shaping going on in their inboxes at all. So what drives such behavior? I feel like the pop 'surveillance capitalism' version starts from bad assumptions.

I feel like if you're going to do a historical materialism in legal theory you should, like, historicize the relationship between the legal and the material?

I am simply planning not to engage any taxonomizing of the stuff I'm trying to say (vis a vis others) until I'm done saying it. That applies to both external critics and fellow travelers. I recommend everyone else to do this too, if we want to actually get something done here.

unpopular opinion: doctrinal scholarship can be really useful and interesting and there should be more of it.

I don't know if law students realize that when a Socratic professor keeps asking questions of a particular student, that's usually because the student is doing an excellent job. In the prof's mind, they're having a really useful exchange, and the prof wants to stick with it.

New: Starbucks’s new commitment to work with Starbucks Workers United union to end hostilities and hash out a “fair process” for labor organizing is a landmark moment for labor relations — both at the coffee chain that’s long resisted organizing, and far beyond it bloomberg.com/news/articles/…

Celebration this morning at the Elmwood Starbucks, where it all began. Bridget has been a rock of the union and a tireless fighter against 2.5 years of the worst union-busting I’ve seen in my career. No one could be more deserving of this victory.

I’d say today makes me incredibly proud, but I’ve always been proud to be a part of this movement and in the company of these amazing workers. And today is no different.

So I’ll just say congratulations!

This is a very big step in the right direction✊🏼
