Alabama residents HB174 is currently moving through the Alabama legislature and could possibly play a role in the continuation of mass incarceration, contribute to the school to prison pipeline, it does not adequately accomplish what it sets out to do.

If passed HB174 would make it a Class A Felony to shoot into an occupied dwelling. This means you can could be face with receiving up to 99 years in prison whether there was a loss of life or not.

but the GAG is this bill was introduced by a Democrat. Some of the Democrats Abstained from voting when in reality they should have simply voted NO

We know from a proven track record that republicans in the state house are quick to want to send someone to jail and they showed that to be true by voting in favor

Basically you could shoot into a house or car that is occupied and not make contact or injure anyone and can be sentenced to 99 years in prison.

It’s important to think about the 2nd and 3rd order of effects of laws we want changed. It is also important to listen to constituents on all sides.
Prison is suppose to be a form of rehabilitation.

There is already a projected path to charging individuals with a Class A Felony for shooting into an occupied space. No one should go to jail for 99 years if they didn’t physically harm anyone it’s as simple as that.

I understand why this bill was authored and introduced but the example cases on why it is needed have resulted in the assailants being charged with felony murder which is CLASS A with the option of the Death Penalty.

I’ve heard the narrative that too many of the assailants are pleading out. That is unfortunate but that issue should be taken up with the District Attorney office that want to avoid trial and are giving the plea deals as options.
