This is well-meaning but wrong. If the horse Biden is kicking were dead, he’d have a point. But it’s very much alive, breathing fire, and rearing to kick us all in the groin. What’s needed is to make the “threat to democracy” pitch more concrete, not to dump it.

If the stakes were lower, I’d say Trump was the schoolyard bully who meets every accusation with a sneer and an “it takes one to know one” taunt. In truth, he’s more like the poor loser who threatens to burn the place down to satisfy his insatiable lust for revenge. Believe him.

Useful implementing legislation (using Sec 5 of the 14th & Secs 3 & 4 of the 20th) to fill gaps in Sec 3 could be a federal statute regulating the stage (primary, general, etc) at which the Disqualification Clause kicks in. But no such law is needed for Sec 3 to be enforceable

If you think SCOTUS is eager to enter this fray, or Trump to shut it down, why did it not offset his delay in seeking cert (12/19 - 1/3) when the challengers alone moved (12/28) for expedition? And why is the supposedly fast briefing schedule so much slower than in Bush v Gore?
