Students should distinguish two ideas:

(1) property & 1st amendment law reflect power & structural vulnerability, & deserve critical scrutiny;

(2) the fact of (1) doesn't mean that you can expect 3rd parties & institutions to acquiesce to a preferred rule, even if they should.
