All that said, as Hugo Lowell notes, DOJ proposed March 18 at the Sec. 5 deadline. If she adopts May 9, but doesn't grant Trump add'l discovery in the meantime, this delay will have been for no good reason -- other than giving Trump's team more time with the docs. Sigh.

Special Counsel proposed March 18 deadline for Trump to file his Sec 5 notice, in order to get to a July 2024 trial. No way that is happening now, given deadline is 7 weeks later. But she also didn’t give Trump the June 17 deadline he wanted — so no 11th Circuit ammo either

ironically the reason why Trump wants FISA restrictions (bc of warrantless eavesdropping) is the same reason liberals afraid of a second Trump admin should want FISA restrictions (to prevent something like FBI Dir Kash Patel using warrantless eavesdropping on never Trump folks)

New: Though Judge Cannon granted the main request from the Special Counsel in the Trump docs case, she used the order to rebuke prosecutors for asking her to reconsider and ruled against prosecutors in allowing testimony transcripts to be public. The Guardian theguardian.com/us-news/2024/a…

And there are some issues where Smith categorically lost, such as withholding substantive testimony that's not witnesses identifying (bc of jury pool or testimony coordination concerns).

Bottom line: Smith's team is HIGHLY annoyed by this ruling.
