there’s uber– conservative, and then there’s plain old wacky. The Supreme Court needs to step in and reaffirm the supremacy of federal law.

So much to be said about this, but one point is simply to publicize it: with this view of presidential power, and his petty, vengeful personality, imagine what a second Trump term would hold for anyone perceived as his enemy.

OK sports fans, Gov Abbott continues to ignore the Supremacy Clause in his immigration policies, but he has an unlikely ally in the 5th Cir court of appeals.

The view that Merrick Garland expressed about the 60 day pre election policy has always been the rule: the policy bars only overt investigative acts. That doesn’t include trials, the timing of which, moreover, is as much in the judiciary and defendant’s hands as the prosecution.

for anyone who lived through this period in NYC, and anyone who didn't, this is a brilliant idea for a book, about not just Goetz but the whole social racial brew of the mid-80s; and Elliot Williams is just the man to carry the idea through. I'll really be looking forward to it.

Allright then. Just want to point out that Ted Boutrous is one of the premier litigators in the county and totally knows his stuff, including this issue, so he's not just whistlin' Dixie (is that an insulting phrase? Joyce Alene ?)

Trump & Habba may trying to create issues for appeal, but so far they haven’t succeeded. But there is one that may be brewing. Courts of appeal typically reduce punitive damage awards that are grossly disproportionate to the compensatory award. Wdnt be surprised if jury does that

Judge Kaplan did a good job at keeping Trump and his lawyer to the relative straight & narrow, n/w/stg lots of provocations by them. The key was having established the ground rules in advance. Looking forward to discussing on All In with Chris Hayes and former judge Nancy Gertner at 8 PM ET.

Perfect little detail illustrating Trump's disrespect for process, judge, and jury: he walked out of the courtroom at the end of court day rather than standing for the jury and waiting for them to exit, as every litigant, lawyer, audience member knows to do.

Don't look now, but while we're focused on Trump's petulance in a NY trial court, his 3 appointees in the Sup Ct may be gearing up to make a fundamental,if arcane, change in admin law. Looking forward to discussing, + Trump news, on Deadline White House w/ host Alicia Menendez at 5 PM ET.

It matters a lot that we're not in the courtroom to see jury reaction & the overall vibe, but seems as if Habba is unskilled, uncharming, and unrestrained. This is her most important task; and she may be pleasing her cloddish client but not likely to be scoring points w/ jury.

An extremely basic skill -- how to impeach a witness with a prior statement -- that Habba apparently doesn't have.
