Some experts: We are not sure that the US Copyright Office and its reports should guide federal copyright legislation. US Copyright Office: hold my beer. We now want to guide federal non-copyright legislation. #copyrightisinyourname copyright.gov/ai/Copyright-a…

Taping fruits to walls is now legal! An artist who taped an orange & banana to a wall loses a copyright lawsuit against another, who taped a banana. Lack of access. A weird case between artists that the district court entertained for much too long. media.ca11.uscourts.gov/opinions/unpub…

As expected, we got an amended (& improved) complaint in X v. Bright Data. IMO, some of the arguments against preemption are weak. But not all. Interestingly, X argues it protects its users' privacy (when selling their data). That's powerful and might require a trial.

.Delta is so weird. I booked a flight to TLV in November. They announced that all flights are cancelled. But on their computer it is not. So their consumer "care" can't really help (like book me a flight with another airline). news.delta.com/delta-pause-fl…

#BULawProf Jessica Silbey reviews Guy Rub's "Reimagining Digital Libraries" for Jotwell, explaining copyright law and "digital lending". She writes, "This means we can resell, lend, or give away our books. What we can’t do is make copies of them." ⬇️ spr.ly/6012U8IGr

It's an interesting case. The #copyright claim here isn't trivial, both because the images are not the same (most of the copying is of style) and because @tesla has a strong fair use defense. Maybe the false endorsement claim has more meat. A great exam question.

My article, Reimagining Digital Libraries, analyzing the struggle of public libraries to adapt to the digital world, and why copyright law should adjust to tackle that new world is now out at the Georgetown Law Journal. Read it while it last.
