@RealDJCthulhu First rule of gun safety, don't point your weapon at anything you don't intend to destroy. Every single instance of this should be an assault charge, at minimum.

Although I'm not sure the way that guy is holding it counts as brandishing

@RealDJCthulhu Dawn McAuley Cursory research indicates 'brandishing' means 'unlawful display', which means making someone aware that you have a firearm to intimidate them while not in a defensive situation.

It depends on state law but this is definitely some sort of crime on top of being really weird.

@RealDJCthulhu Dawn McAuley I was just wondering if brandishing legally required implied displaying willingness and immediate ability to shoot but apparently it only needs to show that the firearm is present.
