#Assange Judge Sharp - appeal is allowed on the issue of protection under the First Amendment (which guarantees free speech).

#Assange Edward Fitzgerald KC There are too many issues of fact which remain unanswered. There are too many issues of law that have arisen for the first time. To take the decision to refuse grounds to appeal would be wrong. A full hearing could consider unresolved issues of law.

Edward Fitzgerald KC: There is no promise, no undertaking and no clarification. This assurance does not rule out the prosecution arguing that the First Amendment will not apply (to #Assange ).

#Assange Mark Summers KC (for Assange) The notion that this is acceptable discrimination on the grounds of nationality is wrong headed. It is also has no application to this case. The law here outlaws discrimination on the basis of nationality.

#Assange James Lewis KC It is difficult to see how the ‘complicity’ and ‘hacking’ (charges) for which Chelsea Manning had no First Amendment protections could ever have Fist Amendment protections for a secondary party.

James Lewis KC (for the US): But, as matter of law, #Assange is a foreigner carrying out criminal acts that affect national security.

James Lewis KC (for the US): We rely heavily on the first line of the assurance – he (Assange) will not be discriminated against because of his nationality.

#Assange Edward Fitzgerald KC Prosecutors in the US commonly give assurances as to how they will take proceedings to reassure a court. There are numerous examples, that that we have listed – 'we will not seek the death penalty, or oppose bail', for example.

Edward Fitzgerald KC: In the end, these are all points for a substantive hearing. There is a real risk of discrimination (because #Assange is not a US citizen.
