In Judge Eicke's dissenting opinion in the Swiss Climate case he makes the points that the Court is opting to overrule the *express vote of Swiss people in their 2021 referendum*, and indeed using that vote as evidence of a violation of human rights:

1. Indefinitely attracting extremely high numbers of migrants may be infeasible

2. No democratic consent for permanent historically unprecedented levels of immigration.

If you are in your 30/40's and went paddling in the sea as child in the 90's there was at least 3x as much sewage in the sea as today.
