Let me put it this way. Would we know if a judge made a decision on defamation or sentencing and then crafted a legal argument to justify that decision?

DA Thomas described in elaborate detail how judges should approach the task of sentencing. I’m sure it affects the justification they give for their sentence. Not sure it affects the actual choice of sentence.

Did I mention the word ‘offence’?

I once conducted a survey of judges which offered them various numerical interpretations of beyond reasonable doubt (e.g. 80% sure, 60% sure etc.). Surprisingly little agreement.

Been reading the full transcript of today’s defamation case. Amazing how Justice Lee moves seamlessly from complex legal argument to beautifully phrased affirmations of commonsense
