Mr Abramjee, with respect, this is extremely wrong and extremely dangerous misinformation to post.

There are many reasons why it’s wrong but I’ll only point out a few:

1. Ethically, a judge cannot recuse themselves simply because they decided a previous case against someone…

… unless what they have said in that previous case creates a *reasonable* apprehension of bias, assessed in context of the facts.

2. Section 167(2) of the Constitution requires a minimum of 8 CC judges to sit on a case, and no acting judges can be appointed for a specific…

… specific case. The CC said so in the Hlophe v FUL 2012(6) SA 13 (CC), para 30 - 42.

3. Judges Schippers and van Zyl, and advocates Dodson and Chaskalson are not currently acting justices of the CC. They will not sit in any case in May, and certainly not on the IEC Zuma case.

4. The CC has not even said that it will hear this case, so questions of who will preside and how are just premature. To suggest that certain judges are already disqualified from sitting in the case is mischievous.

R25 million looks a bit low, why not R50 million rather.
