The right to self defence under international law - if applicable at all in Gaza - is not a “Get Out Of Jail Free” Card. A state can absolutely commit war crimes falling under the ICC’s jurisdiction while exercising self-defence.

FWIW, I do not believe #ICC Prosecutor Khan will be swayed by Netanyahu's hysteria or the threats of certain Western states.

This is the same jurisdictional basis used for Afghanistan, Myanmar and Ukraine. The US even praised the ICC for its arrest warrant for Putin. The idea that it was invented just to “go after Israel” simply is not true

From a historical point of view this is completely correct: genocide has been a regular feature of conflict throughout modernity, sadly continuing in the 21st century.

Ok so, 1) the ICC cannot arrest anyone 2) States cannot arrest anyone for the ICC before the ICC issues an arrest warrant and 3) the most likely scenario is for the ICC to issue arrest warrants against both Israeli and Hamas leadership
